Terms and Conditions covering Tamasa products
The Terms and Conditions apply exclusively between the company Tamasa Distribution SARL, 122 rue La Boétie, 75008 Paris and anyone who visits or purchases via the website www.tamasadiffusion.com or www.tamasaboutique.com.
All web users may have access to the Terms and Conditions which can be modified at any time by Tamasa but the Terms and Conditions in effect at the date of order will be applicable.
Article 1 - Price
1.1 - The price of our products is shown in Euros all tax included (VAT and other taxes such as those applicable to DVD sales). It does not include mailing and packaging costs (see Delivery time and cost).
1.2 - For all orders outside mainland France, you are the importer of the product or products. All custom duties, local tax, import tax and all other taxes connected with the importation of the item or items are at your charge and will not be, under any circumstances, the responsibility of Tamasa Distribution. They are your entire and sole responsibility both in terms of declaration as well as payment to the relevant authorities in your country. We strongly advise you to take advice about these different taxes and regulations from your national or local authorities.
1.3 - Tamasa Distribution reserves the right to change its prices at any time; the product will be invoiced according to the price in effect at the time of order.
1.4 - The products remain the property of Tamasa Distribution until full payment of the invoice is received.
1.5 - The products sold by Tamasa Distribution are for private use only.
Article 2 - Delivery time and cost
Packaging and mailing costs are based on flat fees according to the number of items ordered and the geographic delivery zone (See Cost of Mailing details). All custom duties and local taxes are to be born solely by addressee when located in DOM TOM or outside the EU.

Article 3 - Ordering
Tamasa Distribution accepts your order under the present Terms and Conditions. You must be over 18 years old and legally able to, or have the parental authorization to, purchase items through the web site. The legal language for the contract is French and all orders will be confirmed in French at the time of shipping.
Tamasa Disbribution reserves the right to cancel or refuse any order from a client with whom there is a financial dispute still standing from a previous order.
Article 4 - Confirmation
You must read, understand, and accept the present Terms and Conditions before confirming you order. By confirming your order you agree to the full terms and conditions stated on the website at this time, and as a result you will not use or refer to any other document, including one of your own device relating to sales conditions. Unless proved to the contrary, the data recorded by Tamasa Distribution will constitute the proof of all the transactions between Tamasa Distrubtion and its clients.
Article 5 - Availability
Information pertaining to products and prices are valid as long as they appear on the website and depending on stock availability. For products not stocked by ourselves, our offers are acceptables on condition that they are available from our supplier. Should an item not be available following acceptance of your order, we will inform you by email or post as soon as we are made aware by our suppliers. Tamasa Distribution cannot be held responsible for out of stock items or delays with DVD release dates. Should part or all of an order paid by cheque turns out to be unavailable, the refund will be made by cheque no later than thirty days after the client's cheque has cleared.
Article 6 - Delivery
When ordering several products which carry different delivery dates, the actual delivery time will be that of the furthest delivery date. Tamasa Distribution cannot be held responsible for any consequences owed to delays in delivery. Should we experience delay in sending the item, we will inform you by email. Your order will be processed upon receipt of your cheque or wire transfer. Consequently delivery time will begin when payment is received.
Article 7 - Payment
Payment can be made:
- either by cheque made out in Euros, from a French bank in France, which will be deposited upon receipt. When ordering from us for the first time, you must enclose a copy of your passport, identity card or utility bill along with your cheque . This request is applicable to all first-time orders to avoid fraudulent use of a third party's bank account. The cheque must be made out to Tamasa Distribution and sent with the order-form to the address below:

Article 8 - Refund
8.1 All our products are guaranteed new and identical to those found on the market.
8.2 You have the right to return the product to us within seven (7) days. The cost of sending and returning the product will be borne by you, our refund being strictly limited to the actual product price. Any order over 100€ including VAT will come with free mailing. Should a cancellation and return bring your total order under this amount, the mailing charges which had originally been waived will become due and as such they will be deducted from your refund.
All returned items must be in their original packaging, including accessories and instructions, accompanied by a copy of the invoice and sent to TAMASA DISTRIBUTION, 122 rue La Boétie 75008 Paris, France.
8.3 - Products can only be returned if the seal of the packaging has not been broken. All items returned incomplete, broken, damaged or dirty will not be refund.
Article 9 - Product conformity
We agree to refund or exchange all seemingly defective, damaged, spoilt items or items that do not correspond to your order. In the case of the latter, please send a detailed account of the problem and return all items concerned. The request must be made within 15 days of delivery. Past that time refunds will be denied. This does not affect your statutory rights, notably those relating to latent defects.
Article 10 - Refunds
Refunds covered in articles 7 and 8 will be carried out within a period of 60 days or less after the return of the items to our offices. A cheque made out to the client who placed the order will be mailed to the address stated on the invoice. No postage will be refunded under any circumstance.
Article 11 - Intellectual Property
11.1 All texts, sound recordings, illustrations, photos, and posters appearing on the Tamasa Distribution website are protected by worldwide copyright and intellectual property provisions. On this basis and subject to the provisions of the code of intellectual property, only private use is permitted save where different or more stringent provisions prevail. Any reproduction of the website in part or in whole is strictly prohibited.
11.2 The DVDs are covered by home use legislation rights and specific restrictions as regards copying, public screenings and rentals do apply. You must abide by the Terms and Conditions relative to the use of the product and Tamasa Distribution will not be responsible for any use outside those specific boundaries.
Article 12 - Responsibilities
Our products meet the requirements of French legislation, and Tamasa Distribution cannot be held responsible if the requirements in the client's country differ (notably in the area of local censorship.) It is your responsibility to check with local authorities if the importation or use of the product or service is in conflict with the legislation in effect.
Tamasa Distribution's responsibility only extends to its web pages. Should there be any discrepancy between a product and its description, Tamasa Distribution's responsibily shall not be sought.
Article 13 - Juridiction - Litigation
French law will apply.
The language of the present contract is originally in French and its French legal terms will prevail.

The information and data you provide are required for processing your order, and then kept on to abide by legal obligation as well as help us to serve you better.
In accordance with the Data Protection Act of 6th January 1978, you have the right to access and update your personal data. Article 15 : Agreement by purchaser
The present Terms and Conditions, as well as our product's prices are accepted and fully agreed to by the client who declares and recognizes to have a full understanding of all the terms herein contained. Furthermore the client will not invoke any other document the terms of which may be contradictory with the present agreement, such as his/her own sales agreement and terms as it is understood the act of placing an order on our website will automatically warrant acceptance of the present Terms and Conditions.
